1. INTRODUCTION
1.1. Curator Property Presentation Co. (“Curator”, “Company”, “we”, “us”, “our”) respects the constitutional right to privacy and recognises the importance of protecting personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”), the Promotion of Access to Information Act 2 of 2000 (“PAIA”), and all other applicable laws and regulations of the Republic of South Africa.
1.2. This Privacy Policy describes how Curator collects, processes, stores, shares, retains and protects Personal Information relating to clients, prospective clients, property owners, real estate agents, workers, employees, contractors, suppliers and users of our digital platforms.
1.3. By engaging our services, accessing our website, using our mobile application, or otherwise providing us with Personal Information, you acknowledge that such information may be processed in accordance with this Privacy Policy.
2. DEFINITIONS
For purposes of this Policy:
2.1. “Personal Information” shall bear the meaning ascribed to it under POPIA and includes, but is not limited to, information relating to an identifiable, living natural person and where applicable, an identifiable juristic person.
2.2. “Processing” means any operation or activity concerning Personal Information, including collection, recording, storage, updating, retrieval, use, distribution, merging, restriction, erasure or destruction.
2.3. “Responsible Party” means Curator Property Presentation Co., being the entity determining the purpose of and means for processing Personal Information.
2.4. “Operator” means a third party who processes Personal Information on behalf of Curator under a written agreement.
2.5. “Data Subject” refers to the natural or juristic person to whom Personal Information relates.
3. STATUS AS RESPONSIBLE PARTY
3.1. Curator acts as the Responsible Party in respect of Personal Information collected directly through:

Booking systems
Customer onboarding processes
Real estate referral mechanisms
Payment processing systems
Operational and service delivery activities
3.2. Where third-party operators process Personal Information on our behalf (including cloud service providers, payment processors and IT service providers), such processing is governed by written agreements requiring appropriate security and confidentiality safeguards.

Curator does not store full card details and relies on secure payment operators for payment processing.

Location information is processed strictly for operational purposes.

5. PURPOSES OF PROCESSING
Personal Information is processed for the following lawful purposes:
5.1. To conclude and perform contracts for property presentation and preparation services.
5.2. To schedule, allocate and manage service bookings.
5.3. To process payments, recurring billing, and mandates.
5.4. To manage contract client benefits and booking limits.
5.5. To provide customer support and respond to enquiries.
5.6. To operate and maintain digital platforms including authentication, booking history and notifications.
5.7. To manage risk, fraud detection, and compliance obligations.
5.8. To comply with legal, regulatory and tax obligations.
5.9. To protect legitimate business interests including operational management and service improvement.
5.10. For marketing communications, subject to consent where required by law.
6. LEGAL GROUNDS FOR PROCESSING
Curator processes Personal Information under one or more of the following lawful bases as provided under POPIA:
6.1. The Data Subject’s consent.
6.2. Performance of a contract to which the Data Subject is party.
6.3. Compliance with a legal obligation.
6.4. Protection of a legitimate interest of the Data Subject.
6.5. Protection of the legitimate interests of Curator or a third party.
7. SPECIAL PERSONAL INFORMATION
7.1. Curator does not intentionally process Special Personal Information as defined under POPIA unless strictly necessary and legally permissible.
7.2. Where such processing becomes necessary, it will be conducted in compliance with Sections 26–33 of POPIA.
8. INFORMATION SHARING AND DISCLOSURE
Personal Information may be shared with:
8.1. Payment service providers.
8.2. Cloud hosting and IT infrastructure providers.
8.3. Real estate agents linked to referred properties.
8.4. Professional advisors including attorneys and auditors.
8.5. Regulatory bodies, law enforcement or government authorities where required by law.
8.6. Insurance providers where relevant to service operations.
All third parties are contractually bound to maintain confidentiality and appropriate security safeguards.
9. CROSS-BORDER TRANSFERS
9.1. Where cloud infrastructure or operators are located outside South Africa, Personal Information may be transferred cross-border.
9.2. Such transfers will occur only where:
The recipient is subject to adequate data protection laws; or
A binding agreement provides an adequate level of protection; or
The Data Subject consents; or
The transfer is otherwise permitted under Section 72 of POPIA.
10. INFORMATION SECURITY
Curator implements appropriate technical and organisational measures to protect Personal Information, including:
Encryption of sensitive data
Role-based access controls
Secure cloud hosting
Authentication protocols
Audit logging
Regular system monitoring
Despite these measures, no method of transmission over the internet is completely secure.
11. RETENTION OF PERSONAL INFORMATION
11.1. Personal Information is retained only for as long as necessary to fulfil the purpose for which it was collected.
11.2. Contractual information is retained for the duration of the contract and for up to five (5) years thereafter, or as required by law.
11.3. Financial records are retained in accordance with tax legislation.
11.4. Where litigation is reasonably anticipated, relevant information may be retained until the matter is resolved.
11.5. Information no longer required is securely deleted or anonymised.
12. DATA SUBJECT RIGHTS
Subject to applicable law, Data Subjects have the right to:
12.1. Access Personal Information held by Curator.
12.2. Request correction or updating of inaccurate information.
12.3. Request deletion of information where there is no lawful basis for retention.
12.4. Object to processing based on legitimate interests.
12.5. Withdraw consent where processing is based on consent.
12.6. Lodge a complaint with the Information Regulator of South Africa.
Requests must be submitted in writing to the Information Officer.

14. BREACH NOTIFICATION
In the event of a security compromise affecting Personal Information, Curator will notify affected Data Subjects and the Information Regulator as required under Section 22 of POPIA.
15. MARKETING COMMUNICATIONS
15.1. Marketing communications will be sent only where permitted by law.
15.2. Data Subjects may opt out of marketing communications at any time by contacting the Information Officer or using in-app settings.
16. AMENDMENTS
Curator reserves the right to amend this Privacy Policy from time to time. The updated version will be published on our website and/or application platform.
